These Terms and Conditions set out the basis on which Waste Disposal Hounslow provides waste collection and disposal services. By placing a booking with us, you agree to be bound by these terms. Please read them carefully before using our services.
In these Terms and Conditions, the following expressions have the meanings set out below:
Company, we or us means the business trading as Waste Disposal Hounslow providing waste collection and related services.
Customer, you or your means the individual, business or organisation requesting and paying for the services.
Services means any waste collection, removal, transportation, recycling or disposal service supplied by the Company to the Customer.
Waste means any items, rubbish, refuse, furniture, appliances, garden waste, construction waste or other materials presented by the Customer for collection, subject to restrictions set out in these terms and in applicable waste regulations.
We provide waste collection and disposal services in Hounslow and surrounding areas. Our services may include one-off collections, scheduled waste removal, bulky item collection, garden waste clearance, household rubbish removal and certain commercial waste collections.
The exact scope of the Services for each booking, including the type and volume of Waste to be collected, access requirements, date and time window, and any additional work such as loading or labour, will be agreed at the time of booking and confirmed in our booking confirmation.
We reserve the right to refuse to collect any Waste that falls outside the agreed scope of Services, is not safely accessible, is prohibited by law, or poses a health, safety or environmental risk.
3.1 Booking Requests
You may request a booking by phone, email or through our online enquiry channels where available. To make a booking, you must provide accurate and complete information, including:
Your name, contact details and collection address.
A clear description of the Waste, including approximate volumes, types of items and any hazardous or unusual materials.
Access information, including parking arrangements, floor level, lift access, time restrictions and any known obstacles.
Your preferred collection date and time window.
3.2 Booking Confirmation
A booking is not confirmed until we have accepted your request and provided a booking confirmation. We may confirm verbally, by text or by email, depending on the booking method. The booking confirmation will include the agreed Services, estimated or fixed price, and any specific conditions relating to the booking.
We reserve the right to decline a booking request at our discretion, for example where the requested Service is outside our service area, the nature of the Waste is unsuitable, or we do not have capacity on the requested date.
3.3 Changes to Bookings
If you need to amend your booking, you must contact us as soon as possible. Any changes are subject to availability and our agreement. Where changes materially affect the nature or volume of the Waste, access, or required labour, we may adjust the price accordingly and will inform you before carrying out the Service.
4.1 Pricing
Our prices are based on factors including type and volume of Waste, labour required, access conditions, distance to disposal facilities and any additional services requested. We may quote a fixed price or an estimated price depending on the information provided.
If, upon arrival, we find that the information provided at the time of booking was materially inaccurate such that the volume, type of Waste or access conditions differ significantly, we may revise the price. If you do not accept the revised price, we may cancel the Service, and a call-out or cancellation charge may apply.
4.2 Payment Methods
Unless otherwise agreed in writing, payment is due on completion of the Service. We may accept cash, card payment, bank transfer or other payment methods as notified to you at the time of booking.
For business Customers, we may, at our discretion, agree credit terms. Where credit terms are agreed, invoices are payable in full within the period stated on the invoice. We reserve the right to withdraw credit terms at any time.
4.3 Late Payment
If you fail to pay any sum due to us by the due date, we may charge interest on the overdue amount at the statutory rate allowed under applicable law, accruing on a daily basis until payment is received in full. We may also suspend further Services until all outstanding sums are paid.
You will be liable for any reasonable costs we incur in recovering overdue sums, including debt collection agency fees and legal costs.
5.1 Customer Cancellations
If you need to cancel your booking, you must notify us as early as possible by phone or email. The following cancellation terms will normally apply:
Cancellations made more than 24 hours before the scheduled collection time will not usually incur a cancellation fee.
Cancellations made within 24 hours of the scheduled collection time may incur a reasonable cancellation charge to cover our costs and loss of opportunity.
Where our staff have already been dispatched to your property or have arrived at the collection address, and you cancel or are unable to proceed, a call-out charge may be applied.
5.2 Rescheduling
We will make reasonable efforts to accommodate requests to reschedule bookings, subject to availability. Rescheduling within 24 hours of the scheduled collection time may be treated as a cancellation and rebooking, at our discretion.
5.3 Company Cancellations
We reserve the right to cancel or postpone a booking at any time for reasons including, but not limited to, vehicle breakdown, severe weather, staff shortages, access issues, safety concerns or regulatory restrictions.
Where we cancel a booking, we will use reasonable efforts to notify you as soon as practicable and to offer an alternative date. Our liability for cancellation by us is limited to the refund of any prepayments you have made for that booking.
6.1 Access and Parking
You are responsible for ensuring that our staff and vehicles have safe and reasonable access to the collection address at the agreed time. This includes arranging any necessary parking, permits or entry permissions and ensuring that driveways, pathways and internal routes are clear.
If adequate access or parking is not available, or we are delayed due to access issues beyond our control, we may charge additional waiting time or a call-out fee, or we may have to cancel the Service.
6.2 Preparation of Waste
You must ensure that all Waste intended for collection is clearly identified and accessible. Where practicable, items should be bagged or bundled for safe handling. You must not present for collection any items that are prohibited under these terms or under relevant waste regulations.
6.3 Hazardous and Prohibited Items
You must inform us in advance if the Waste includes any items that may be hazardous, contaminated, sharp, heavy or otherwise require special handling. We reserve the right to refuse to handle such items or to charge additional fees where permitted by law for specialist handling and disposal.
We do not generally accept certain hazardous or regulated wastes, including but not limited to asbestos, clinical and medical waste, certain chemicals, gas cylinders, pressurised containers, explosives, radioactive materials or any substances that we are not licensed or insured to handle.
7.1 Legal Compliance
We operate in accordance with applicable UK waste management legislation and regulations, including duty of care obligations relating to the handling, transportation and disposal of controlled waste.
By using our Services, you confirm that you have the legal right to dispose of the Waste and that we are authorised to remove it from the property. You must not request us to collect Waste that has been fly-tipped, illegally stored or obtained through unlawful means.
7.2 Transfer and Disposal
Once collected, Waste will be transported to appropriate licensed facilities for re-use, recycling, recovery or disposal, as determined by us in compliance with applicable regulations. We may separate different types of Waste to maximise recycling and reduce landfill, where practicable.
For certain commercial collections, we may provide waste transfer notes or similar documentation where required by law. You must retain any such documentation in accordance with regulatory requirements.
7.3 Environmental Standards
We aim to provide a responsible waste collection service with a focus on recycling and lawful disposal. However, we do not guarantee that any particular item will be recycled or re-used, and decisions regarding the final treatment of Waste will be taken in line with environmental regulations, site availability and commercial practicality.
8.1 Our Responsibility
We will exercise reasonable care and skill in providing the Services. If we fail to comply with these terms, our responsibility is limited to the loss or damage you suffer that is a direct and foreseeable result of our breach or negligence.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot legally be excluded or limited.
8.2 Exclusions and Limitations
To the fullest extent permitted by law, we will not be liable for:
Any loss of profit, business, revenue, opportunity, goodwill or anticipated savings.
Any indirect, consequential or purely economic loss or damage.
Loss or damage arising from inaccurate or incomplete information provided by you.
Loss or damage arising from failure to follow our instructions or guidance.
Our total liability to you in relation to any one booking, whether in contract, tort including negligence or otherwise, shall be limited to the total amount paid or payable by you for that booking.
8.3 Property Damage
Our staff will take reasonable care when carrying out the Services at your property. You are responsible for protecting any areas, fixtures, fittings or items that may be vulnerable to damage during the removal of Waste.
We shall not be liable for damage arising from inherent defects, pre-existing conditions, poor installation, structural weaknesses, concealed obstructions, or where we have followed your express instructions against our advice.
Any alleged damage must be reported to us as soon as reasonably practicable and, in any event, within 48 hours of completion of the Service, together with supporting evidence.
We maintain appropriate business insurance for the Services we provide, including public liability insurance at a level we consider suitable for our operations. Details of our current insurance can be made available on request.
We recommend that you maintain your own insurance for your property and possessions, and that you check any relevant policy terms and exclusions.
We will collect, store and use your personal information only for the purposes of managing your booking, providing the Services, processing payments, and where applicable, complying with our legal obligations.
We may contact you using the details you provide in order to confirm bookings, provide service updates, resolve issues or request feedback. We will take reasonable steps to keep your personal data secure and will not sell your information to third parties.
We may share your information with trusted service providers, such as payment processors or waste facility operators, where necessary for the performance of our Services or where required by law.
If you are dissatisfied with any aspect of our Services, please contact us promptly with details of your concerns. We will investigate and aim to resolve complaints in a fair and timely manner.
Where a dispute cannot be resolved informally, either party may pursue their rights through the courts in accordance with the governing law and jurisdiction set out below.
We may update or amend these Terms and Conditions from time to time. Any changes will take effect when the updated terms are published or otherwise made available to you. The version in force at the time of your booking will apply to that booking.
If we make significant changes that materially affect your rights or obligations, we will take reasonable steps to bring these to your attention.
These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of England and Wales.
You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter, including any non-contractual disputes or claims.
14.1 Entire Agreement
These Terms and Conditions, together with any booking confirmation or written agreement between us, constitute the entire agreement between you and us in relation to the Services. You acknowledge that you have not relied on any statement or representation not expressly set out in these documents.
14.2 Severability
If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be treated as deleted, but the remaining provisions shall continue in full force and effect.
14.3 Assignment
You may not transfer, assign or subcontract your rights or obligations under these Terms and Conditions without our prior written consent. We may assign or subcontract our rights and obligations where reasonably necessary in connection with the operation of our business, provided that this does not materially affect the level of Service you receive.
14.4 No Waiver
Our failure or delay in exercising any right or remedy under these Terms and Conditions shall not constitute a waiver of that or any other right or remedy. Any waiver must be given in writing.
